1. Scope
These Terms & Conditions (the “Terms”) govern your use of the APAN System, including the APAN mobile application, web portals, and related services operated by Agile Advance Sdn Bhd (“Agile Advance”, “we”, “us”). By accessing or using APAN, you agree to these Terms.
2. Terms of Use
By accessing or using the APAN System, you agree to the following terms and conditions:
- Use of APAN is limited to authorized personnel involved in debt collection and site visits.
- Users must not share login credentials or misuse collected data.
- All usage is monitored for security and compliance purposes.
- Violations may result in access termination. For questions, email [email protected].
3. Definitions
- Assignment Data: Information associated with an assignment, including metadata, rider allocation, notes, statuses and survey entries.
- Images: Digital photographs captured or uploaded via APAN.
- Rider Assigned Data: Records mapping riders/recovery officers to assignments.
- Assignment Import: Batches of assignments imported into the system for processing.
4. Data Retention & Purge
4.1 Images (DR & VACANT)
- All images are automatically deleted 45 days after upload/capture for DR and VACANT assignments.
- The deletion process runs daily.
- It is the customer’s responsibility to download and keep copies needed beyond 45 days.
4.2 Assignment Data
- Customers should remove completed assignments weekly to avoid unnecessary storage and load.
- Export reports you need to retain before removal.
Performance: Regular housekeeping (exporting & removing completed items) keeps the platform responsive and reliable for everyone.
5. Housekeeping Responsibilities
- Rider Assigned Data: Remove Assigned IDs weekly once riders/recovery officers complete their tasks.
- Assignment Import: Export completed items weekly, then remove them from the system.
- Surveys & Images: Export weekly so you always hold the latest copies.
6. Backups
- System backups are performed once every two weeks as a courtesy service.
- Backups are not a substitute for your own records; they may not contain your latest changes.
- You are responsible for maintaining independent backups of your data.
Important: Agile Advance is not liable for loss of files or data residing on customer accounts. Restoration, if available, is limited to the last available backup.

8. Limitation of Liability
To the maximum extent permitted by law, Agile Advance Sdn Bhd shall have no liability whatsoever for any damages, losses, or claims (whether direct, indirect, incidental, special, consequential, punitive, or otherwise) arising out of or in connection with the use of the APAN System. Customers acknowledge and agree that they are solely responsible for maintaining independent backups of all data and that the APAN System is provided on an “as is” and “as available” basis.
9. Changes to These Terms
We may update these Terms from time to time. Changes are effective upon posting. Your continued use of the APAN System constitutes acceptance of the updated Terms.
